Terms of Service

1. Agreement

By accessing or using Benwer Cars ("Benwer", "the Service"), you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company.

2. The Service

Benwer provides software for car rental operators, including admin tools, marketplace listings, and booking websites. Features and availability may change as we improve the product. We aim for high availability but do not guarantee uninterrupted access.

3. Accounts

You are responsible for safeguarding login credentials and for activity under your account. You must provide accurate business information and keep fleet and pricing data up to date so customer-facing channels remain correct.

4. Plans, fees & billing

Some features are available on free plans; paid plans are billed as described on our pricing page. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.

5. Your responsibilities

You agree not to:

• Use the Service unlawfully or to mislead customers
• Upload false availability, pricing, or vehicle information
• Attempt to access other users' data or disrupt the platform
• Reverse engineer or resell the Service except as permitted

You remain responsible for your rental contracts, insurance, taxes, and compliance with local transport and consumer laws.

6. Marketplace & booking channels

Listing on the Benwer marketplace does not guarantee bookings. We may moderate listings or suspend accounts that harm customers or the marketplace. Booking requests may require your confirmation in admin according to your settings.

7. Intellectual property

Benwer owns the platform, branding, and software. You retain ownership of your business data and brand assets. You grant us a license to host, display, and process your content as needed to operate the Service.

8. Disclaimer & liability

The Service is provided "as is" to the extent permitted by law. Benwer is not liable for indirect, incidental, or consequential damages, or for lost profits arising from downtime, booking disputes, or third-party actions. Our total liability is limited to fees paid to Benwer in the twelve months before the claim, unless mandatory law says otherwise.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the platform. Upon termination, your right to use the Service ends; export provisions may apply as described in your plan.

10. Governing law & contact

These Terms are governed by the laws of Spain, without regard to conflict of law rules. Courts in Málaga, Spain shall have exclusive jurisdiction, unless mandatory consumer law provides otherwise.
